General Terms and Conditions

You are legally capable of entering into a binding contract with us.

You accept and comply with our Terms of Service and Privacy Policy.

Consideration: Different pricing and payment policies may apply to various services. You agree to pay all fees and charges associated with the services you purchase, and you authorize MakeTunes or its payment processors to charge your selected payment method.

Changes to this Agreement: We may modify this Agreement at any time without prior notice. Updated terms become effective when posted. Your continued use of the Service after changes are posted means you accept the revised Agreement.

Privacy Policy: Access to and use of the Service are subject to the MakeTunes Privacy Policy. By using the Service, you consent to the collection and use of information as described in that policy.

Eligibility: The Service is not available to users previously suspended or removed by MakeTunes. By using the Service, you represent that you meet all eligibility requirements.

Account Security

You are responsible for maintaining the security of your account and password. You agree to provide accurate, current, and complete information and to keep it updated.

You must notify MakeTunes immediately at [email protected] if you know of or suspect any unauthorized use of your account or any other breach of security.

MakeTunes is not liable for any loss or damage arising from your failure to comply with these account security obligations.

Restrictions on Use of the Service

In addition to other restrictions in this Agreement, you agree not to:

• Upload, post, transmit, share, store, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or otherwise objectionable.
• Create a new account after MakeTunes has disabled your account, unless you have our written permission.
• Provide false personal information, create an account for anyone other than yourself without permission, or misrepresent your identity or affiliation.
• Create a false identity or impersonate another person or entity.
• Solicit personal information from anyone under the age of 18 or solicit passwords or personally identifying information for unlawful purposes.
• Restrict, discourage, or inhibit any person from using the Service, or disclose personal information about another user without consent.
• Use the Service for any commercial or unauthorized purpose without MakeTunes consent.
• Use MakeTunes names, trademarks, service marks, logos, domain names, or other distinctive brand features without our prior written consent.
• Gain or attempt to gain unauthorized access to the Service, user accounts, computer systems, or networks connected to the Service.
• Access, tamper with, or use non-public areas of the Service, MakeTunes computer systems, or technical delivery systems.
• Make unauthorized copies, modify, adapt, translate, reverse engineer, disassemble, decompile, or create derivative works from any part of the Service.
• Delete or alter any material uploaded by MakeTunes or another person or entity.
• Modify, deface, bypass, or interfere with security-related features, copyright notices, or other proprietary rights notices.
• Reverse engineer or attempt to discover source code, object code, or underlying structure, ideas, or algorithms of the Service.
• Frame, mirror, or link to materials or content on the Service without authorization.
• Upload or transmit viruses, worms, spyware, malware, or any other malicious code.
• Use the Service in violation of applicable laws, regulations, these Terms, or any other rules provided by MakeTunes.
• Interfere with, disrupt, or create an undue burden on the Service, servers, or networks connected to the Service.
• Use any device, software, routine, robot, scraper, or other automated means to interfere with the proper working of the Service.

User Content

You are responsible for all prompts, lyrics, audio, images, text, data, files, links, and other materials that you submit, upload, create, or otherwise make available through the Service.

You represent and warrant that you own or have all rights, licenses, permissions, and consents necessary to submit your content and to allow MakeTunes to process it for the purpose of operating and improving the Service.

Input Restrictions

We prohibit the following types of content:

• Unauthorized non-original content, including material you do not own or do not have the right to use.
• Hate speech, harassment, threats, abuse, or content targeting individuals or groups based on protected characteristics.
• Illegal and restricted material, including content that promotes unlawful activity, exploitation, violence, or regulated goods or services.
• Privacy and personal data, including private information about another person without permission.
• Malicious code, automated inputs, spam, attempts to manipulate the Service, or content intended to harm MakeTunes or its users.

Audio Usage Rights

Free Plan Users: AI-generated audio created by free users cannot be used commercially unless MakeTunes expressly states otherwise in writing or in the applicable plan terms.

Paid Plan Users: Subject to these Terms and your compliance with them, paid users are granted the right to use AI-generated audio commercially according to the permissions and limitations of the paid plan purchased.

AI-Generated Content and Originality Disclaimer

AI-generated outputs are algorithmic and MakeTunes does not guarantee absolute originality, uniqueness, copyrightability, or that outputs will not be similar to content generated for other users or existing works.

Users assume all risks related to infringement, ownership, commercial use, licensing, and clearance of AI-generated outputs. You are responsible for reviewing outputs before using, publishing, distributing, or monetizing them.

User Responsibility and Liability Waiver

Users bear sole responsibility for the content they submit and the outputs they create or use through the Service.

By using the Service, you agree to indemnify and hold MakeTunes harmless from claims, damages, losses, liabilities, costs, and expenses arising from your content, your use of generated outputs, or your violation of these Terms.

Intellectual Property

All content, software, design, text, graphics, logos, interfaces, trademarks, service marks, and other materials on the Site and Service are the exclusive property of MakeTunes or its licensors, except for user content and generated outputs as otherwise described in these Terms.

By using the Service, you acknowledge and agree to respect the intellectual property rights of MakeTunes and third parties.

Indemnification

You agree to indemnify, defend, and hold harmless MakeTunes, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys fees, arising from your use of the Service, your content, generated outputs you use, or your breach of these Terms.

Disclaimer of Warranties

The Service is provided on an as-is and as-available basis. MakeTunes disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.

MakeTunes does not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that generated outputs will meet your expectations or requirements.

Term and Termination

This Agreement begins when you first access or use the Service and continues until terminated by you or MakeTunes.

MakeTunes reserves the right to restrict, suspend, or terminate your access to all or part of the Service at any time if we believe you have violated these Terms or if necessary to protect the Service, users, or third parties.

MakeTunes may change, suspend, or discontinue any part of the Service at any time, with or without notice.

Refund Policy

MakeTunes offers a 3-day refund policy. To qualify, you must request a refund within 3 days of purchase and must not have used more than 50 credits.

Approved refunds are processed using the original payment method and may take up to 10 business days to appear, depending on your payment provider.

MakeTunes may refuse refunds where there is a violation of these Terms, suspected fraud, abuse of the refund policy, or other misuse of the Service.
